09/02/2024 - Kirklees Council's Gas Supply Contract ref: 11834    Recommendations Approved

The Council’s current arrangements relating to the supply of gas are via a framework consortium managed by Yorkshire Purchasing Organisation (YPO). The current Gas Supply contract expires in March 2025 and due to this the potential options available in terms of gas supply have been explored and assessed.  When deciding on how to proceed with the gas supply contract, consideration has been given to several factors including contract cost, gas purchasing strategy, confidence/assurance of the organisation, assurance of supply, contract term/length as well as potential transitional costs and implications associated with any move away from the incumbent provider.

 

Due to the ongoing, significantly high costs for gas and therefore the contract value and level of financial risk to the Council, the decision required a high-level strategic decision over signing the new Gas Supply contract and the future procurement of energy. Utility contracts are considered as day-to-day expenditure in the Council’s constitution, where the expenditure could reasonably be regarded as having been in the contemplation of members when the revenue budget was approved. Therefore, the Strategic Director for Corporate Strategy, Commissioning & Public Health can make the decision on how to proceed under delegated powers, in consultation with the Service Director for Finance (S151 Officer) and Portfolio Holders.  The decision required was whether to:

 

·   Remain with YPO and sign the new YPO Gas contract with their new gas supplier (yet to be confirmed/appointed).

·   Move Gas supply arrangements to another public purchasing organisation and sign up to their Gas Supply framework. Out of the viable other framework providers Crown Commercial Service (CCS) is considered as the best option.

 

At a meeting held on 9th February 2024, the options available were presented to the Strategic Director for Corporate Strategy, Commissioning & Public Health and the Service Director for Finance, along with:

·       Service Director for Legal, Governance and Commissioning

·       Head of Risk

·       Head of Procurement

 

All senior officers present at the meeting gave their full support for the decision to move away from YPO and to enter into an agreement with CCS, using the Locked 12 (L12) basket.

 

It was noted that a retrospective cabinet note would not be required, but that this could be reported to Finance.

 

It was suggested that once the Council has signed with CCS, at the appropriate time there can be a review of the two baskets for gas and electricity supply together.

 

The Strategic Director Corporate Strategy, Commissioning & Public Health agreed on the approach presented in the meeting and concluded with the decision to move to the CCS Gas Supply Framework using the Locked 12 (L12) basket.

 

At a meeting held on 21st February 2024, the following Portfolio Holders were briefed about the options which were available:

The Portfolio Holders gave their support to the decision to proceed with the move to the CCS Gas Supply Framework using the Locked 12 (L12) basket.

The purpose of this report is to seek Cabinet approval to proposed changes to how we commission Domestic Abuse Support Services within existing resources.

 

The proposal is to adopt an outcomes-based commissioning approach to improve how we meet the needs of individuals, families and communities who are impacted by Domestic Abuse.

 

Our vision for Kirklees is to work holistically with individuals, families and communities to prevent, respond to and repair the damage caused by domestic abuse.

 

There has been a series of engagement events from August 2022 through to December 2023 including existing Domestic Abuse Commissioned service providers, members of the Domestic Abuse Strategic Partnership, a public engagement questionnaire, Councillor sessions, and a number of co-production sessions with key stakeholders and those with lived experience of domestic abuse.

 

Throughout the engagement process, all relevant stakeholders as outlined in the above section have been consulted (including non-statutory) on the approach to commissioning and change to one individual provider. No issues arising from consultation with specialist/statutory providers, public and ward councillors, Domestic Abuse Partnership, KBOP Coproduction panel.

The Council, as Lead Local Flood Authority, has a legal duty under the Flood and Water Management Act 2010 to produce, implement and monitor a Local Flood Risk Management Strategy (Local Strategy). Council’s original strategy was published in 2013, a summary refresh was made in 2019 to provide an up-to-date evidence base to support the measures identified in the current Action Plan.

 

The Local Strategy summarises the duties, responsibilities and actions that the Council will embrace to manage local sources of flood risk. It must align with the National Strategy produced by the Environment Agency.

 

A revised National Strategy was published in July 2020 and was formally adopted by government in September 2020. This strategy describes what needs to be done by all risk management authorities (RMAs) involved in flood and coastal erosion risk management for the benefit of people and places. 

 

This has been a key driver to reviewing our current Local Flood Risk Management Strategy in ensuring alignment with the National Strategy.

The reason to deviate from the statutory guidance issued by the Department for Transport is that there is a robust decision-making process already in place.  The Committee is confident with the quality of decisions made by the Group Leader which are consistent and made in a timely manner. The Licensing and Safety Committee has overview of those decisions in the Licensing and Safety Committees, and the process falls in line with other West Yorkshire Authorities.  Changing the current process would incur costs to the Council and to the trade.

Local Authorities are required to consult with early years providers and Schools Forum when setting their Early Years Funding Formula. Under very tight DfE timelines, a consultation took place between 15 December 2023 and closed on 21 January 2024. Taking account of the outcomes of the consultation proposals matching the decision below were supported by Schools Forum on 9th February.

3.    Increase the amount retained centrally by £167,200. £123,800 to support administration of the new entitlements and £43,400 for 5% inflation on the total amount to be retained.

4.    Create a contingency fund of 0.8% from each funding stream. Funds will be paid to providers and not used for any other purpose.

5.    Transfer £500,000 from the Early Years Block to the High Needs Block in 2024-25 to support financial sustainability as per the Safety Valve Agreement with the Department for Education.

6.    SENDIF budget is set at £2 million, which includes a £1 million contribution from the Early Years Block in addition to the £1 million contribution already agreed from the High Needs Block.

7.    The method for allocating SENDIF will take into consideration children identified at SEN Support, without the need for a Panel process and to include a clear monitoring process to ensure that SENDIF is being targeted effectively at those children identified as eligible.

The enabling works form part of the £6.180m Pre-Construction Services Agreement(PCSA) budget. This budget covers the period up to starting the main construction works on site.

 

At the time of the Cabinet report the enabling works were budgeted at £1.105m. The scope of the works now includes additional items and the value that will be instructed is £1.281m. However, the original PCSA budget of £6.180m will be maintained with the difference of £176k being funded from reallocation of monies from within the PCSA budget.

 

The works will be carried out between the 11thMarch and the 10thJune 2024. The main construction works are then programmed to commence on the 10thJune subject to agreement on the contract sum, all as set out in the Cabinet report
