Purpose:

o Cooper Bridge Corridor Improvement scheme is a scheme funded by the West Yorkshire plus Transport Fund (WY+TF).

 

Authority is sought to:

 

-       Progress the scheme in principle

 

-       Subject to West Yorkshire Combined Authority (WYCA) approval, authorisation is sought to accept additional grant funding, enter into a revised Funding Agreement with WYCA and incur expenditure to develop the scheme to Full Business Case with costs. 

 

-       Acquire land in principle.   

 

Pursuant to Regulation 10 of the Local Authorities (Executive Arrangements) (Meetings and Access to Information) (England) Regulations 2012 (‘the Regulations’), Cabinet intends to make a Key Decision on behalf of Kirklees Council on 12th October 2021 regarding A62 to Cooper Bridge Corridor Improvement Scheme.

 

It has not been possible to give 28 clear days’ notice of the intention to make the Key Decision (KDN).  The reasons why compliance is impracticable in this matter is due to the fact that delays in finalising the Cabinet Report in respect of finalising technical matters have resulted in a slight delay to KDN posting, however in order to keep the programme, in particular timely submission of the OBC it is important that a KDN is published without delay.

 

Please note that the A62 to Cooper Bridge Corridor Improvement scheme was subject to Placeholder Economy and Neighbourhood Scrutiny on 24th August 2021.

 

As required by Regulation 10 of the Regulations, the Chair of the Overview and Scrutiny Management Committee has been informed of the matter about which the Key Decision is to be made by and given the above notice.

 

Wards affected - Ashbrow, Liversedge & Gomersal, Mirfield, Brighouse.  Given the strategic location of this scheme is has the potential to impact wards across the wider Kirklees/Calderdale districts.

 

Decision:

1)    That approval be given in principle to the scheme.

2)    That approval be given to accept and enter into any agreement with the West Yorkshire Combined Authority for the funding to work up the A62 to Cooper Bridge Scheme to full business case.

3)    That approval be given to incur expenditure in the working up of the scheme if the Council’s application to the West Yorkshire Combined Authority for funding is successful.

4)    That authority be delegated to the Strategic Director Growth & Regeneration to negotiate and agree the terms of any agreements that may be necessary to work up the A62 to Cooper Bridge Scheme including the funding agreement with the West Yorkshire Combined Authority.

5)    That authority be delegated to the Service Director – Legal, Governance & Commissioning to enter into the grant agreement with the West Yorkshire Combined Authority for the funding of the A62 to Cooper Bridge and any other relevant agreements and documents to which the Council is party.

6)    That authority be given for the acquisition of land in principle as part of a land assembly.

7)    That it be noted the design team’s commitment to work with and place shape the scheme with residents and businesses.

8)    That it be noted the land negotiations will commence subject to funding approval of the outline business case.

9)    That it be noted that the project will return to Cabinet to secure authority to make compulsory purchase orders in relation to the scheme, where necessary.
