Decision:

 

RESOLVED -

That the application for the full variation in respect of premises known as, Empire House, Lewisham Road, Slaithwaite, Huddersfield, HD7 5AL, be approved as requested.

Minutes:

The Panel considered a report which outlined an application for the full variation of Empire House, Lewisham Road, Slaithwaite, Huddersfield, HD7 5AL.

 

The Licensing Officer advised the Panel that on the 9th April 2025, the Licensing Department received an application for the full variation of a premises Licence, in respect of Empire House, Lewisham Road, Slaithwaite, Huddersfield, HD7 5AL.

 

The licensable activities applied for were:-

 

-         Sale of alcohol (on and off the premises) Monday – Sunday 08:00 – 23:00. 

 

The premises currently has a licence in place, and the licensable activities are as follows:-

-         Sale of Alcohol (on and off the premises) Monday – Sunday 08:00 – 22:00

 

-         Sale of Alcohol (on and off the premises) New Years Eve 08:00 – 01:00 (The Following Day)

 

In response to the application, one representation was received from a local resident objecting to the variation.

 

The applicant advised the Panel that the premises is a business members club which has been operating for over four years.  The closing time for the business is 23:00 hours, however, alcohol can only be sold up until 22:00 hours.  By increasing the hours of sale of alcohol would give the business more flexibility to cater for events and bring it in line with other businesses in the area.

 

The representation received from a member of the public stated that the licensing objectives in respect of the Prevention of Crime and Disorder, Public Safety, the Prevention of Public Nuisance and the Protection of Children from Harm would not be achieved if the variation was granted.  Concerns were also raised that there would likely be an increase in noise, anti-social behaviour and public nuisance and asked that the application be rejected. 

 

Having considered all the information presented both verbally and in writing, the Panel, in reaching its decision, had due regard to the provisions of the Licensing Act 2003, the statutory guidance issued under section 182 of the Act, the Councils Statement of Licensing Policy and the relevant provisions of the Human Rights Act.

 

RESOLVED -

That the application for the full variation in respect of premises known as, Empire House, Lewisham Road, Slaithwaite, Huddersfield, HD7 5AL, be approved as requested.
