RESOLVED –

 

That the application be granted with the following conditions:

 

Sale of alcohol (off premises) Monday to Sunday - 6:00am – 10:00pm.

The Panel considered a report which outlined an application for the Grant of a Premises Licence for Shawcross Store Ltd, 128 Smallwood Road, Shaw Cross, Dewsbury, WF15 7RR.</AI8>

 

The Licensing Officer advised the Panel that on the 7th July 2025, the Licensing Department received an application for the Grant of a Premises License in respect of Shawcross Store Ltd,128 Smallwood Road, Shaw Cross, Dewsbury, WF15 7RR.

 

The licensable activity applied for was as follows:

 

Sale of Alcohol (off the premises) Monday to Sunday – 06:00 – 23:00

 

In response to the application, representations were received from two Ward Councillors in relation to the following licensing objectives not being achieved if the application was granted:

 

  • Prevention of Crime and Disorder
  • Public Safety
  • Prevention of Public Nuisance
  • Protection of Children from Harm.

 

No objections had been received from Responsible Authorities.

 

The applicant’s representative advised the Panel that the applicant had significant experience in convenience retailing and alcohol sales. The shop had been running for 15 years, and the applicant planned to invest and revitalise the business which residents were in support of. The applicant would be partnering with Premier who were a well-known wholesaler and provided assurance in terms of products and services. A new CCTV system had been installed, and appropriate staff training would take place annually to ensure the licensing objectives were upheld. The applicant’s representative also advised the Panel that the applicant was willing to amend the licensable hours applied for from 6:00 - 23:00 to 6:00 - 22:00.

 

The representations received, also highlighted concerns that the shop was situated in a residential area which was already under strain from crime, anti-social behaviour and environmental disturbance and that the sale of alcohol would increase the vulnerability and isolation of elderly resident.

 

The applicant was advised of the planning application submitted in 2019, which was a variation of condition 4 of the original application in 2015 relating to opening hours. As per condition 2, the current opening hours for Shawcross Store Ltd were 10:00 – 21:30 Monday to Saturday and 11:00 – 20:00 Sundays.

 

 

Having considered all the information presented both verbally and in writing, the Panel, in reaching its decision, had due regard to the provisions of the Licensing Act 2003, the statutory guidance issued under section 182 of the Act, the Councils Statement of Licensing Policy and the relevant provisions of the Human Rights Act.

 

 

RESOLVED –

 

That the application be granted with the following conditions:

 

Sale of alcohol (off premises) Monday to Sunday - 6:00 – 22:00.
