The Committee gave consideration to Application 2025/92728 – Erection of 33 dwellings with associated car parking and landscaping land at Dowker Street, Milnsbridge, Huddersfield.
RESOLVED –
1) That authority be delegated to the Head of Planning and Development to approve the application, issue the decision notice and complete the list of conditions including matters relating to;
- Three years to commence development
- Development to be carried out in accordance with the approved plans and documents
- Samples of all walling materials
- Notwithstanding the submitted plans, plots 1-3 to be developed from natural stone to the front and gable elevations
- Notwithstanding the submitted plans, the roofing materials to include artificial or natural blue slate, including samples
- Details of windows and doors
- All windows to be set back into the reveal by 100mm
- Full details/locations of PV panels
- Full details/locations of the air source heat pumps
- Full details of boundary treatments
- Details of measures to deter crime and anti-social behaviour
- Submission of a CEMP
- Management and maintenance of green space
- Submission of full drainage details
- Management and maintenance of drainage features (crate storage/attenuation)
- Bin store details
- Details of temporary waste storage and collection (during construction)

2) That authority be delegated to the Head of Planning and Development to secure a S106 Agreement to cover (i) management and maintenance (the establishment of a management company for the purpose of maintaining the shared green open spaces (including ecological management), the private parking areas and infrastructure (including surface water drainage until formally adopted by the statutory undertaker) and (ii) facilitate the implementation of a TRO for the sum of £10,000.
3) That, pursuant to (2) above, in circumstances where the S106 Agreement has not been completed within three months of this decision, the Head of Planning and Development shall be authorised to consider whether permission should be refused on the grounds that the proposals are unacceptable in the absence of the benefits that would have been secured, and would therefore be permitted to determine the Application and impose appropriate reasons for refusal under delegated powers.
