Decision:

To approve the minutes of the meeting of the Panel held on 4 November 2015.

Decision:

The Minutes of the meeting of the Committee held on 4 November 2015 were approved as a correct record.

The Councillors will be asked to say if there are any items on the Agenda in which they have disclosable pecuniary interests, which would prevent them from participating in any discussion of the items or participating in any vote upon the items, or any other interests.

Decision:

No interests were declared.

Admission of the Public

Most debates take place in public. This only changes when there is a need to consider certain issues, for instance, commercially sensitive information or details concerning an individual. You will be told at this point whether there are any items on the Agenda which are to be discussed in private.

Decision:

The Committee considered the question of the exclusion of the public and determined that all items be taken in public session.

Deputations/Petitions

The Committee will receive any petitions and hear any deputations from members of the public. A deputation is where up to five people can attend the meeting and make a presentation on some particular issue of concern. A member of the public can also hand in a petition at the meeting but that petition should relate to something on which the body has powers and responsibilities.

The Committee will hear any questions from the general public.

This report is for Members to note proposals to additions and amendments to the scheme of delegation in relation to the Town Police Clauses Act 1847 and the Local Government (Miscellaneous Provisions) Act 1976.

Decision:

That the report be noted and submitted to Council on 20 January 2016 with the recommendation that the changes to the Delegation Scheme as outlined and to delegate the authority to the Assistant Director, Legal Governance and Monitoring to make the appropriate amendments and any consequential changes to the Constitution.

Constitution - Taxi and Private Hire Vehicles: Delegation of Enforcement Powers pdf icon PDF 54 KB

This report is for members to note additions and amendments to the scheme of delegation in relation to enforcement powers under the Town Police Clauses Act 1847 and the Local Government (Miscellaneous Provisions) Act 1976.

Decision:

That the report be noted and submitted to Council on 20 January 2016 with the recommendations that (i) approval be given for the Taxi and Private Hire Enforcement Powers as set out at paragraph 3.8 of the report be delegated by Kirklees Council to the other West Yorkshire Authorities and City of York Council, as well as being retained by Kirklees Council as Licensing Authority as detailed in paragraph 3.1. (ii) that approval be given to Kirklees Council receiving similar delegated enforcement powers from the other West Yorkshire and City of York Authorities, (iii) that authority be delegated to the Assistant Director (Legal, Governance and Monitoring) to make the appropriate amendments, and any consequential changes to the Constitution.

 

That the Assistant Director, Legal, Governance and Monitoring be asked to investigate the possibility of also delegating Enforcement Authority in respect of Authorities not listed within paragraph 3.1, in instances where drivers apply for trade in Kirklees and to make the appropriate Constitutional amendments to this delegation.
