Application approved (delegated).

Minutes:

 

The Committee gave consideration to Application 2025/92440 – Erection of four dwellings at Lumb Lane Nurseries, Lumb Lane, Almondbury.

 

Under the provisions of Council Procedure Rule 37, the Committee received representations from Janine Riley, Suzi Ellis and Richard Ellis (local residents), Ben Marsden (applicant) and Peter Roberts (in support of the application).

 

RESOLVED – That authority be delegated to the Head of Planning and Development to approve the application, issue the decision notice and complete the list of conditions including matters relating to;  

 

-       standard conditions regarding time scale

-       in full accordance with plans

-       sample materials

-       windows and doors should be timber or metal and recessed by 100 –150mm

-       remove permitted development rights

-       soft landscaping scheme

-       boundary treatment scheme

-       front boundary wall to be no taller than 900mm

-       approved vehicle parking areas would need to be surfaced and drained

-       construction management plan

-       scheme detailing the location and cross sectional information together with the proposed design and construction details for all new retaining walls

-       construction (environmental) management plan

-       precautionary working method statement

-       badger survey

-       full invasive species survey and management plan

-       artificial lighting strategy

-       phase 2 intrusive site investigation report

-       remediation strategy

-       implementation of the remediation strategy

-       submission of verification report

 

A Recorded Vote was taken in accordance with Council Procedure Rule 42 (5) as follows;

 

To Refuse

For: Councillors Bellamy, Davies and Scott (3 votes)

Against: Councillors Firth, Sokhal and Ullah (3 votes)

Abstained: Councillors Lee Richards and Kahut

 

In accordance with Council Procedure Rule 42(2), the Chair applied their entitlement to a casting vote and voted against the proposal to refuse the application. The motion was not, therefore, carried.

For: Councillors Firth, Sokhal and Ullah (3 votes)

Against: Councillors Bellamy, Davies and Scott (3 votes)

Abstained: Councillors Lee Richards and Kahut

 

In accordance with Council Procedure Rule 42(2), the Chair applied their entitlement to a casting vote and voted in support of the proposal to approve the application.
