RESOLVED:

 

That the premises licence in respect of the Three Fiends be granted as follows:

-             Films:

To be removed from the licence

 

-             The supply of alcohol for consumption on and off the premises:

Mon:               09:00 – 21:00 hrs

-             Tues – Thurs:  09:00 – 17:00 hrs

-             Fri- Sun:         09:00 – 21:00 hrs

 

Notices to be erected giving clear instructions that patrons are to leave the premises in and quiet and orderly manner.

 

Minutes:

The Panel considered a report which outlined an application for the Grant of a Premises Licence for the Three Fiends, Brookfield Farm,148 Mill Moor Road, Meltham, Holmfirth, HD9 5LN.

 

At the start of the hearing, the Chair advised that the application for the grant of a premises licence for the Three Fiends Brewhouse was originally scheduled to be heard on the 27 April 2021, however a decision was taken to defer the hearing to a later date to allow a site visit to be undertaken.   A site visit was undertaken on the 18 May 2021.

 

The Licensing Officer outlined the application advising the Panel that on 3rd March 2021, the Licensing Department received an application for the grant of a premises licence for the Three Fiends Brewhouse. The establishment currently benefits from a premise licence issued on the 28 August 2015, for off Sales:  Mon – Sun: 08:00 – 22:00 hrs.

 

The licensable activities applied for were:

-             Films:

Fri – Mon: 12:00 – 23:00 hrs

 

-             The supply of alcohol for consumption on and off the premises:

Fri – Mon: 09:00 – 23:00 hrs

Tues – Thurs: 09:00 – 17:00 hrs

 

The Licensing Officer explained that during the consultation period, no representations were received from the Responsible Authorities, however, concerns were raised by local residents initially resulting in four representations.  The Panel was informed that as one of the representations was in respect of planning matters it had to be discounted resulting in three valid representations.  The licensing officer clarified the matters that a planning authority would consider and the matters that were licensing matters.

 

The applicant informed the Panel that the intention is not to open the bar every day of the week but to carry on holding occasional events and a premises licence would give more flexibility. The reason for requesting 12:00 – 23:00 hrs timings on a Monday is purely for Bank Holidays.  The films aspect of the application was not a significant feature and could therefore be removed from the licence.

Representations were made by local residents who informed the Panel that there is inadequate and limited parking which presents a significant safety hazard particularly when cars are parked on corners.  In addition, intensification of business activity particularly with the potential number of patrons the venue could attract to events will create public nuisance as disorderly behaviour is likely to increase.

Following careful consideration of all the representations received both verbally and in writing, the Panel:

 

RESOLVED

 

That:

the premises licence in respect of the Three Fiends be granted as follows:

-             Films to be removed for the licence on the grounds that the applicant indicated that he did not wish to pursue this part of the application.

 

-             The supply of alcohol for consumption on and off the premises:

Mon:               09:00 – 21:00 hrs

Tue - Thurs:    09:00 – 17:00 hrs

Fri - Sun:         09:00 – 21:00 hrs

 

-             Notices are to be erected giving clear instructions that patrons are to leave the premises in and quiet and orderly manner.
