Holme Valley Neighbourhood Development Plan Next Steps following referendum

Following endorsement by Cabinet (31st August 2021), the Holme Valley Neighbourhood Development Plan (NDP) will progress to referendum to be held on 4th November 2021.

Section 38A (4)(a) of the Planning and Compulsory Purchase Act 2004 requires the council to make (adopt) the Neighbourhood Plan if more than half of those voting in the referendum have voted in favour of the Plan being used to help decide planning applications in the area.

 

The Neighbourhood Planning (General) and Development Management Procedure (Amendment) Regulations 2016 Regulation 18A states that the Plan should be made within 8 weeks of the referendum.

 

Subject to a successful referendum as outlined above and the requirement for this to be within 8 weeks of the date of the referendum, a report will be taken to Full Council to formally make (adopt) the Plan.

 

If the NDP is made (adopted), it will form part of the statutory development plan and full weight can be given to the Plan in the determination of planning applications within the Holme Valley Neighbourhood Area alongside the Kirklees Local Plan.
