Adoption of Moving Traffic Enforcement Powers

To provide an update to Cabinet on Moving Traffic Enforcement (MTE), the results of the application from Kirklees to the Department for Transport (DfT) to apply for trial MTE powers. The update will include the outcome of recent public consultation and details of the subsequent approval by DfT for Kirklees to begin utilising these powers.??Approval will be sought to progress with enforcement.

 

Engagement and Consultation

 

The Council undertook a 6-week public consultation on six potential sites, including engaging with elected members in all wards for their feedback, and email alert was sent to special interest groups of key concern.

 

The statutory process for consultation was prescribed by DfT, and followed, also informed by the examples of Leeds and Calderdale who have consulted on the same.

 

Support for enhanced enforcement was clear. The results of the consultation were used in combination with survey data and a technical review (of road layout, road markings, signage and existing TROs) to select three of the six sites for the proposed trial of powers. was undertaken, along with audit of TROs.

 

Engagement with WYCA, Leeds City Council and Calderdale Council to incorporate experience of other councils in this emerging practice in enforcement management across England. 

 

Collaboration across Highways, Parking Enforcement, and Major Project Service to establish local need, to understand the scale of issues to demonstrate proportionality, and to inform a shortlist of potential enforcement sites for a trial of camera use. This shortlist was then tested against the rigour of DfT guidance on how and when to apply new enforcement powers.
