Kirklees Council’s current Home to
School Policy makes provision for transport beyond the scope of the
legislative requirements as conferred by the Education Act 1996.
Discretionary provision in Home to School Transport at Kirklees is
delivered in two main areas: Post 16 provision (both mainstream and
SEN) and transport based on faith to eligible pupils this Key
decision deals with transport based on faith only.
Following a public consultation from 2nd February to 2nd April 2015
and a resolution from Cabinet on 2nd June 2015 to support the
option in paragraph 5.4 of the Cabinet Report to “remove the
provision of all transport assistance to current children that
travel to a school chosen because of a parent’s or a
child’s religion or belief from September 2016” and
following legal advice that the Council must take express
consideration of the PSED and the Council’s statutory
obligation to consider using its discretionary powers under Section
508C Education Act 1996, this report seeks approval of the revised
Policy for Home to School Transport 2015/16.
