Decision:

That the minutes of meeting held on 7th December 2020 be approved as a correct record.

The Councillors will be asked to say if there are any items on the Agenda in which they have disclosable pecuniary interests, which would prevent them from participating in any discussion of the items or participating in any vote upon the items, or any other interests.

Decision:

No interests were declared.

3.

Admission of the Public

Most debates take place in public. This only changes when there is a need to consider certain issues, for instance, commercially sensitive information or details concerning an individual. You will be told at this point whether there are any items on the Agenda which are to be discussed in private.

Decision:

That agenda items 1 – 6 be considered in public session.

 

That the public be excluded from the hearing in accordance with Regulation 14(2) of the Licensing Act 2003 (Hearings) Regulations 2005 and Section 100 (A)(4) of the Local Government Act 1972 during consideration of agenda item 8.

 

4.

Deputations/Petitions

The Committee will receive any petitions and hear any deputations from members of the public. A deputation is where up to five people can attend the meeting and make a presentation on some particular issue of concern. A member of the public can also hand in a petition at the meeting but that petition should relate to something on which the body has powers and responsibilities.

 

In accordance with Council Procedure Rule 10 (2), Members of the Public should provide at least 24 hours’ notice of presenting a deputation.  

 

Decision:

No deputations or petitions received.

5.

Questions by members of the public (Written Questions)

Due to current Covid-19 restrictions, Elected Members and members of the public may submit written questions to members of the Licensing Panel. Any questions should be emailed to Nicola.sylvester@kirklees.gov.uk no later than 5pm on Monday 1 March 2021.

 

In accordance with Council Procedure Rule 51(10) each person may submit a maximum of 4 written questions. In accordance with Council Procedure Rule 11(5), the period allowed for the asking and answering of public questions will not exceed 15 minutes. The Panel will provide an oral response to any questions received, or if they are not able to do so, a written response will be provided.

Decision:

The panel resolved that in order to promote the licensing objectives the conditions stipulated by West Yorkshire Police be applied to the licence which should include the following –

 

a)    The premises shall install and maintain comprehensive digital colour CCTV system to cover all public areas including all public entry and exit points;

b)    A minimum of two SIA Approved door staff to be employed Friday and Saturday night from 20:00 until all customers have left the premises;

c)    A recognised personal Licence Holders Course from the British Institute of Inn Keeping to be completed by the Licensee and DPS;

d)     No persons under the age of 18 years of age to be allowed on the premises after 18:00;

e)    An incident log to be kept at the premises for at least six months and made available on request to relevant authorities;

f)     A full risk assessment to be in place for Covid-19 to a standard approved by Kirklees Environmental Health;

g)    Monitoring visits to be carried out by the relevant authorities
